മുസ്ലിം വിലക്കിനു സുപ്രീം കോടതിയുടെ ഇടക്കാല അംഗീകാരം; ട്രമ്പിന്റെ വിജയം

വാഷിംങ്ങ്ടണ്‍, ഡി.സി: പ്രസിഡന്റ് ട്രമ്പിന്റെ മുസ്ലിം വിലക്കിനു സുപ്രീം കോടതിയുടേ താല്‍ക്കാലിക അംഗീകാരം.
ഇതോടെ ഇറാന്‍, ലിബിയ, സിറിയ, യെമന്‍, സൊമാലിയ, ചാഡ് എന്നീ മുസ്ലിം രാജ്യങ്ങളില്‍ നിന്നുള്ളവര്‍ക്ക് അമേരിക്കയില്‍ വരുന്നതിനു വിലക്കുണ്ടാകും. മുസ്ലിം രാജ്യമല്ലെങ്കിലും നോര്‍ത്ത് കൊറിയക്കും ഇത് ബാധകമണ്. വെനസ്വേലയില്‍ നിന്നുള്ള ചില വിഭാഗങ്ങല്‍ക്കും വിലക്കുണ്ട്.
പ്രസിഡന്റ് ട്രമ്പ് ഭരണകൂടത്തിനു ലഭിച്ച വലിയ വിജയമാണിത്. മുസ്ലിം രാജ്യങ്ങളില്‍ നിന്നുള്ളവര്‍ക്ക് അമേരിക്കയില്‍വരുന്നതിനു വിലക്ക് ഏര്‍പ്പെടുത്തിയ ഉത്തരവ് ചോദ്യം ചെയ്തുള്ള ഹര്‍ജിയില്‍ തീരുമാനമാകും വരെ പ്രസിഡന്റിന്റെ ഉത്തരവ് പ്രാബല്യത്തില്‍ തുടരുമെന്നാണു സുപ്രീം കോടതി ഉത്തരവ്.
പ്രസ്തുത രാജ്യങ്ങളില്‍ നിന്നു വരുന്ന ഗ്രീന്‍ കാര്‍ഡുള്ളവര്‍ക്കും വിസയുള്ളവര്‍ക്കും അമേരിക്കയില്‍ വരാന്‍ തടസമുണ്ടാകും എന്നതാണു സ്ഥിതി.
പ്രസിഡന്റ് ട്രമ്പ് സ്ഥാനമേറ്റയുടന്‍ കഴിഞ്ഞ ജനുവരിയില്‍ പുറപ്പെടുവിച്ച മുസ്ലിം നിരോധനം കോടതി കയ്യോടേ റദ്ദ് ചെയ്ത സാഹചര്യത്തില്‍ ട്രമ്പ് പുതിയ ഓര്‍ഡര്‍ മാര്‍ച്ചില്‍ ഇറക്കി. എന്നാല്‍ അമേരിക്കയില്‍, ബന്ധമുള്ളവരെ തടയരുതെന്നു മെരിലാന്‍ഡ് ഡിസ്ട്രിക്ട് കോടതി ഉത്തരവിട്ടു. വിലക്ക് ഹാവായിയീലെ ഫെഡറല്‍ ഡിസ്ട്രിക്റ്റ് കോടതി റദ്ദാക്കി.
ഈ വിധികള്‍ക്കെതിരെ ഭരണകൂടം അപ്പീല്‍ കോടതികളില്‍ അപ്പീല്‍ കൊടുത്തു. അപ്പീലുകള്‍ തീരുമാനമാകും മുന്‍പ് കേസ് സുപ്രീം കോടതിയില്‍ എത്തി. അതില്‍ തീരുമാനമാകും വരെയുള്ള ഇടാക്കാല ഉത്തരവാണു കോടതി പുറപ്പെടുവിച്ചിരിക്കുന്നത്.
കോടതി ഉത്തരവ് വംശ വിവേചനത്തിനും അതിക്രമങ്ങള്‍ക്കും ഇടയാക്കുമെന്നു സന്നദ്ധ സംഘടനകള്‍ ചൂണ്ടിക്കാട്ടി
The ruling lifted restrictions imposed by lower courts on the travel ban, which bars all citizens of Syria, Iran, Chad, Yemen, Somalia, Libya and the Democratic People's Republic of Korea, as well as certain officials from Venezuela from entering the US.
"In light of its decision to consider the case on an expedited basis, we expect that the Court of Appeals will render its decision with appropriate dispatch," Xinhua news agency quoted the Supreme Court ruling as saying.
The travel ban, released in September, was the third version by the Trump administration.
The Trump administration said the ban was needed to ensure national security, while critics said it was a form of religious discrimination as most of the countries impacted by the ban are Muslim majorities.

US Supreme Court allows Trump's third travel ban to go into effect
Washington, Dec 5 (IANS) The US Supreme Court on Monday allowed the third version of the Trump administration's travel ban to take effect, impacting citizens of eight countries from entering the US.
The ruling lifted restrictions imposed by lower courts on the travel ban, which bars all citizens of Syria, Iran, Chad, Yemen, Somalia, Libya and the Democratic People's Republic of Korea, as well as certain officials from Venezuela from entering the US.
"In light of its decision to consider the case on an expedited basis, we expect that the Court of Appeals will render its decision with appropriate dispatch," Xinhua news agency quoted the Supreme Court ruling as saying.

Meanwhile, South Asian Americans Leading Together (SAALT)said that it is deeply disappointed in the Supreme Court’s decision to allow full implementation of “Muslim Ban 3.0" during the appeals process. In response, Suman Raghunathan, Executive Director of SAALT, released the following statement:
“No one should be discriminated against on the basis of how they look, how they choose to pray, or their country of origin. ‘Muslim Ban 3.0’ remains reprehensible at its core and discriminatory in its intent. While the Supreme Court did not rule on the merits of the ‘Muslim Ban,’ court after court has consistently rejected it as outright discrimination and a threat to our most fundamental constitutional protections.
The third version of the ‘Muslim Ban’ will only contribute to a worsening climate of hate aimed at our communities. The Supreme Court’s decision comes on the heels of the President tweeting incendiary and irresponsible anti-Muslim videos last week, posts applauded by white supremacists such as David Duke and denounced by the British Prime Minister and civil rights organizations.
Anti-Muslim policies and rhetoric continue to have deadly consequences. The FBI’s 2016 hate crimes statistics reveal that assaults against Muslims have surpassed levels reached in the aftermath of the 9/11 attacks. Since the election, SAALT has documented over 205 incidents of hate violence aimed at South Asian, Muslim, Sikh, Hindu, Arab, and Middle Eastern Americans, a 58% increase from the year prior. Due to a massive underreporting of hate crimes, we know this is just a fraction of the attacks our communities experience regularly.
We will not remain silent in the face of these divisive and un-American policies. Our communities will stand united at airports, marches, and in the courts. The majority of Americans are against the ‘Muslim Ban’ and we will continue to sound the alarm against policies that drag our country backwards. To form a more perfect union, we must begin by standing against the ‘Muslim Ban.’”
