നിയമവിരുദ്ധമായി കുടിയേറിയ മാതാപിതാക്കളെ ക്രിമിനല്‍ കുറ്റത്തിന് തടവില്‍ വച്ച് വിചാരണ ചെയ്യുമ്പോള്‍ അവരുടെ കുട്ടികളെ അവരില്‍ നിന്ന് അകറ്റണമെന്ന ഡിപ്പാര്‍ട്ട്‌മെന്റ് ഓഫ് ഹോംലാന്‍ഡ് സെക്യൂരിറ്റിയുടെ തീരുമാനം ഡെമോക്രാറ്റിക് സെനറ്റര്‍മാരുടെയും ജനപ്രതിനിധികളുടെയും കടുത്ത വിമര്‍ശനത്തിന് കാരണമായിരിക്കുകയാണ്.
ഇന്ത്യന്‍ വംശജയും കാലിഫോര്‍ണിയയില്‍ നിന്നുള്ള ഡെമോക്രാറ്റിക് സെനറ്ററുമായ കമല ഹാരിസ് ഈ പ്രശ്‌നം കഴിഞ്ഞ ഡിസംബര്‍ മുതല്‍ ഹോംലാന്‍ഡ് സെക്യൂരിറ്റി ഡിപ്പാര്‍ട്ടുമെന്റ് സെക്രട്ടറി ക്രിസ്റ്റ്‌ജെന്‍ നീല്‍സണോട്് ഉന്നയിച്ച നീണ്ട വാഗ്വാദം നടത്തിയ അറ്റേണി ജനറല്‍ ജെഫ് സെഷന്‍സ് ഈയിടെ പറഞ്ഞ അഭിപ്രായത്തില്‍ നിയമവിരുദ്ധമായി രാജ്യത്ത് പ്രവേശിക്കുന്നവോരോട് സീറോ ടോളറന്‍സ് നയം അവലംബിച്ചാല്‍ കൂടുതല്‍ കുടുംബങ്ങളെ വേര്‍തിരിക്കും, മാതാപിതാക്കളെ പ്രോസിക്യൂട്ട് ചെയ്യപ്പെടുമ്പോള്‍ അവരുടെ കുട്ടികള്‍ ഒറ്റപ്പെട്ടുപോകും എന്ന് വ്യക്തമാക്കിയിരുന്നു.
ഇതെക്കുറിച്ചാണ് ഹാരിസ് നീല്‍സണിനോട് ചോദിച്ചത്. കുടുംബങ്ങളില്‍ നിന്ന് കുട്ടികളെ എടുക്കുന്നത് നിയമവിരുദ്ധ കുടിയേറ്റത്തെ ഭയപ്പെടുത്തി പിന്തിരിപ്പിക്കുവാനല്ല, മറിച്ച് ഒരാള്‍ നിയമവിരുദ്ധമായി അതിര്‍ത്തി കടക്കുകയാണെങ്കില്‍ അയാളെ പ്രോസിക്യൂട്ട് ചെയ്യാന്‍ ഏല്‍പിക്കും. അയാള്‍ യു.എസ്.നിയമം ലംഘിച്ചതിനാലാണിത്, നീല്‍സണ്‍ മറുപടി നല്‍കി.
അങ്ങനെയാണെങ്കില്‍ നിയമവിരുദ്ധമായി കുടിയേറിയ മാതാപിതാക്കളെ ക്രിമിനല്‍ കുറ്റത്തിന് വിചാരണ ചെയ്യുമ്പോള്‍ അവരുടെ നാല് വയസ്സുള്ള കുട്ടിക്ക് എന്ത് സംഭവിക്കും?, ഹാരിസ് ചോദിച്ചു.
നമ്മള്‍ എന്താണ് ചെയ്യുക എന്ന് പറഞ്ഞാല്‍ നിയമം ലംഘിച്ച മാതാപിതാക്കളെ പ്രോസിക്യൂട്ട് ചെയ്യും. യു.എണൈറ്റഡ് സ്‌റ്റേറ്റ്‌സ് ഓഫ് അമേരിക്കയില്‍ ഓരോ ദിവസവും ചെയ്യുന്നത് പോലെ, നീല്‍സണ്‍ പറഞ്ഞു. ഈ കുട്ടികളെ 48 മണിക്കൂറിനുള്ളില്‍ ഡിപ്പാര്‍ട്ടുമെന്റ് ഓഫ് ഹെല്‍ത്ത് ആന്റ് ഹ്യൂമന്‍ സര്‍വീസസി(എച്ച് എച്ച് എസിന്റെ) കസ്റ്റഡിയിലേയ്ക്ക് മാറ്റുന്നു. മാതാപിതാക്കള്‍ കസ്റ്റഡിയില്‍ വിചാരണ കാത്ത് കഴിയുമ്പോള്‍ കുട്ടികള്‍ മറ്റൊരു കുടുംബത്തില്‍ ഫോസ്റ്റര്‍ കെയറില്‍ ആയിരിക്കും, നീല്‍സണ്‍ കൂട്ടിചേര്‍ത്തു.
'അതായത് കുട്ടികളെ അവരുടെ മാതാപിതാക്കളില്‍ നിന്ന് അകറ്റും.' ഹാരിസ് പറഞ്ഞു.
'നമ്മള്‍ യുണൈറ്റഡ് സ്റ്റേറ്റില്‍ ഓരോ ദിവസവും ചെയ്യുന്നത് പോലെ,' നീല്‍സണ്‍ കൂടുതല്‍ വ്യക്തത വരുത്തി.
ഫോസ്റ്റര്‍ കെയറില്‍ ഏല്‍പിക്കുന്ന കുട്ടികളുടെ സംരക്ഷണത്തില്‍ ഡിപ്പാര്‍ട്ട്‌മെന്റിന്റെ കൂടുതല്‍ മേല്‍നോട്ടം ഉണ്ടാവണം എന്ന മൊണ്ടാനയില്‍ നിന്നുള്ള സെനറ്റര്‍ ക്ലെയര്‍ മക്കാ സ്‌ക്കില്ലിന്റെ നിര്‍ദേശത്തോട് നീല്‍സണ്‍ അനുകൂല പ്രതികരണം നടത്തി. തന്റെ ഏജന്‍സിയും എച്ച് എച്ച് എസും കുട്ടികളെ സംരക്ഷിക്കുന്നവര്‍ കുറ്റവാളികളായിരിക്കരുത് എന്ന കാര്യത്തില്‍ ജാഗ്രത പുലര്‍ത്തുന്നു എന്ന് നീല്‍സണ്‍ പറഞ്ഞു.
കുടിയേറ്റ കുട്ടികളെ മിലിട്ടറി ബേസുകളില്‍ താമസിപ്പിക്കുവാന്‍ ഉദ്ദേശിക്കുന്നതായി ഡിഫന്‍സ് ഡിപ്പാര്‍ട്ട്‌മെന്റിന്റെ സന്ദേശങ്ങളില്‍ നിന്ന് വ്യക്തമാക്കുന്നതായി റിപ്പോര്‍ട്ടുകള്‍ പറയുന്നു. ടെക്‌സസിലും അര്‍ക്കന്‍സയിലുമുള്ള നാല് മിലിട്ടറി സ്ഥാപനങ്ങളില്‍ അടുത്ത രണ്ടാഴ്ചയ്ക്കുള്ളില്‍ എച്ച്എച്ച്എസ് സന്ദര്‍ശനങ്ങള്‍ നടത്തി അഭയാര്‍ത്ഥി കേന്ദ്രങ്ങളാക്കുവാനുള്ള സൗകര്യങ്ങള്‍ പരിശോധിക്കും. എച്ച്എച്ച്എസിന് ഇപ്പോള്‍ 10,571 കുട്ടികളെ തങ്ങളുടെ ശൃംഖലയിലുള്ള ഫോസ്റ്റര്‍ കെയര്‍ സെന്ററുകളില്‍ താമസിപ്പിക്കുവാന്‍ കഴിയും. ഇപ്പോള്‍ ഈ സെന്ററുകളില്‍ 91 % വും നിറഞ്ഞു കഴിഞ്ഞിരിക്കുകയാണ്.
