ഖൊബ്രഗാഡെയെ (39) അറസ്റ്റ്‌ ചെയ്‌തത്‌ ഇന്ത്യന്‍ അമേരിക്കന്‍ ജനതയ്‌ക്ക്‌
നാണക്കേടായി. വീട്ടുവേലക്കാരി ന്യൂയോര്‍ക്കിലെ കോണ്‍സുലേറ്റ്‌
ഉദ്യോഗസ്ഥര്‍ക്കെതിരേ തിരിയുന്ന മൂന്നാമത്തെ സംഭവമാണിത്‌.
മെഡിക്കല്‍ ഡോക്‌ടറും, ഐ.എഫ്‌.എസ്‌ ഓഫീസറുമാണ്‌ ഡോ. ദേവയാനി. അവരുടെ പിതാവും മുംബൈയില്‍ ഐ.എ.എസ്‌ ഉദ്യോഗസ്ഥനാണ്‌. അറസ്റ്റിനെ തുടര്‍ന്ന്‌ ഇന്ത്യന്‍ എംബസി അമേരിക്കന്‍ ഗവണ്‍മെന്റിനെ ശക്തമായ പ്രതിക്ഷേധം അറിയിച്ചിട്ടുണ്ട്‌.
പുത്രിയെ സ്‌കൂളില്‍ വിടുവാന്‍ പോയപ്പോഴാണ്‌ ഡോ. ദേവയാനിയെ അറസ്റ്റ്‌ ചെയ്‌തത്‌. പിന്നീട്‌ ജാമ്യത്തില്‍ വിട്ടു.
സംഗീതാ റിച്ചാര്‍ഡ്‌ എന്ന മുന്‍ വേലക്കാരിയുടെ പരാതിയിലാണ്‌ അറസ്റ്റ്‌ എന്നു കരുതുന്നതായി എംബസിയുടെ പത്രക്കുറിപ്പില്‍ പറയുന്നു. ഈ സ്‌ത്രീയെ ജൂണ്‍ മുതല്‍ കാണാനില്ല. ഡോ. ദേവയാനിക്കെതിരേ എന്തെങ്കിലും നിയമ നടപടികള്‍ ഇന്ത്യയ്‌ക്കു പുറത്ത്‌ എടുക്കരുതെന്ന്‌ ഡല്‍ഹി ഹൈക്കോടതി സെപ്‌റ്റംബറില്‍ സംഗീതയോട്‌ ഉത്തരവിട്ടിരുന്നു.
ഡല്‍ഹി മജിസ്‌ട്രേറ്റ്‌ കോടതി സംഗീതയ്‌ക്കെതിരേ അറസ്റ്റ്‌ വാറണ്ട്‌ പുറപ്പെടുവിച്ചിരുന്നു. അവരെ കണ്ടെത്താന്‍ സഹായിക്കണമെന്ന്‌ ഇന്ത്യന്‍ എംബസി അമേരിക്കയോട്‌ അഭ്യര്‍ത്ഥിക്കുകയും ചെയ്‌തിരുന്നതാണ്‌. ഈ പശ്ചാത്തലത്തില്‍ പ്രശ്‌നം ശ്രദ്ധയോടെ കൈകാര്യം ചെയ്യണമെന്നും, ഡോ. ദേവയാനിയുടെ ഡിപ്ലോമാറ്റിക്‌ സ്റ്റാറ്റസ്‌ പരിഗണിക്കണമെന്നും കൂടി എംബസി നിര്‍ദേശിച്ചിരുന്നു.
ഇതൊന്നും കണക്കിലെടുക്കാതെയാണ്‌ ഇന്ത്യക്കാരനായ പ്രീത്‌ ഭരാരയുടെ നേതൃത്വത്തിലുള്ള യു.എസ്‌ അറ്റോര്‍ണി ഓഫീസ്‌ അവരെ അറസ്റ്റ്‌ ചെയ്‌തത്‌.
ഇന്ത്യയില്‍ നടന്ന സംഭവത്തെച്ചൊല്ലിയാണ്‌ കേസ്‌. സ്വന്തരാജ്യത്ത്‌ നയതന്ത്ര പരിരക്ഷ കിട്ടില്ല. അമേരിക്കയില്‍ വെച്ചായിരുന്നു നടന്നിരുന്നതെങ്കില്‍ പരിരക്ഷ കിട്ടുമായിരുന്നുവെന്ന്‌ അറ്റോര്‍ണിമാര്‍ പറയുന്നു. അതുപോലെ തന്നെ സംഗീതയോട്‌ കേസ്‌ കൊടുക്കരുതെന്ന്‌ ഡല്‍ഹി ഹൈക്കോടതി പറഞ്ഞത്‌. ഇവിടെ കേസ്‌ എടുത്തത്‌ യു.എസ്‌ അറ്റോര്‍ണിയാണ്‌. അഥവാ അമേരിക്കന്‍ ഭരണകൂടമാണ്‌.
പത്തുവര്‍ഷം വരെ ജയില്‍ശിക്ഷ കിട്ടാവുന്ന കുറ്റമാണ്‌ ഡോ. ദേവയാനിക്കെതിരേ ചുമത്തിയിരിക്കുന്നത്‌. കഴിഞ്ഞവര്‍ഷം നവംബറില്‍ ന്യൂയോര്‍ക്കില്‍ ജോലിക്കുചേരാന്‍ സംഗീതയ്‌ക്കുവേണ്ടി ഡോ. ദേവയാനി എ- ത്രീ (A-3) വിസയ്‌ക്ക്‌ അപേക്ഷ നല്‍കി. പ്രതിമാസം 4500 ഡോളര്‍ ശമ്പളം നല്‍കുമെന്നായിരുന്നു അതില്‍ പറഞ്ഞിരുന്നത്‌! (രണ്ടര ലക്ഷം രൂപ !)
എന്നാല്‍ പ്രതിമാസം 30,000 രൂപ എന്നു ഇരുവരും തമ്മില്‍ ധാരണയുണ്ടാക്കിയിരുന്നു (573 ഡോളര്‍). 40 മണിക്കൂര്‍ ജോലി.
ആറു മാസത്തേക്കാണ്‌ സംഗീത അവര്‍ക്കുവേണ്ടി ജോലി ചെയ്‌തത്‌. പറഞ്ഞുറപ്പിച്ച 30,000 രൂപ പോലും പ്രതിമാസം അവര്‍ക്കു കിട്ടിയില്ലെന്ന്‌ ചാര്‍ജ്‌ ഷീറ്റില്‍ പറയുന്നു.
വിസ ഫ്രോഡ്‌, തെറ്റായ സത്യവാങ്‌മൂലം നല്‍കല്‍ എന്നിങ്ങനെ രണ്ട്‌ കുറ്റങ്ങളാണ്‌ അവരുടെ പേരില്‍ ചുമത്തിയിരിക്കുന്നത്‌.
എന്തായാലും അറസ്റ്റ്‌ ഒഴിവാക്കാമായിരുന്നുവെന്നാണ്‌ ഇന്ത്യന്‍ സമൂഹത്തിന്റെ പൊതുവെയുള്ള ചിന്താഗതി. അവരെ തിരിച്ചുവിളിക്കാന്‍ അമേരിക്കയ്‌ക്ക്‌ ഇന്ത്യയോട്‌ ആവശ്യപ്പെടാമായിരുന്നു.
വീട്ടുവേലയ്‌ക്ക്‌ ആളെ കൊണ്ടുവരുന്നതും ശരിയായ വിസയില്ലാത്തവരെ ജോലിക്കു വെയ്‌ക്കുന്നതും വിഷമത്തിലേക്ക്‌ നയിക്കുമെന്നതിന്‌ മറ്റൊരു തെളിവുകൂടിയായി ഇത്‌.
മറ്റെല്ലാ കേസുകളിലും വീട്ടുവേലക്കാരികള്‍ ഏതാനും വര്‍ഷം കഴിഞ്ഞാണ്‌ കേസിനു പോയിട്ടുള്ളത്‌. ഇവിടെ ആറുമാസംകൊണ്ട്‌ അത്‌ സംഭവിച്ചതാണ്‌ അതിശയം.

diplomats was arrested in New York Thursday for alleged visa fraud and
exploitation of her domestic help leading to expression of "strong
concern" by the Indian embassy in Washington.
Devyani Khobragade, 39, India's Deputy consul general in New York was charged with one count of visa fraud and one count of making false statements, which carry maximum sentences of 10 years and five years in prison, respectively.
In response to media queries, the Indian embassy said it had conveyed its "strong concern to the US government over the action taken against Khobragade" and urged the US side "to resolve the matter with due sensitivity," taking into account a pending court case in India and the diplomatic status of Khobragade.
Announcing the Indian diplomat's arrest in New York, Manhattan's Indian-American US attorney Preet Bharara alleged that she had caused "materially false and fraudulent statements" to be made in support of a visa application for an Indian national employed as a babysitter and housekeeper at her home in New York.
"Foreign nationals brought to the United States to serve as domestic workers are entitled to the same protections against exploitation as those afforded to United States citizens," he said.
"The false statements and fraud alleged to have occurred here were designed to circumvent those protections so that a visa would issue for a domestic worker who was promised far less than a fair wage," Bharara said.
"This type of fraud on the United States and exploitation of an individual will not be tolerated," he said.
But the Indian embassy statement's said action was apparently taken against Khobragade "on the basis of allegations raised by the officer's former India-based domestic assistant, Sangeeta Richard, who has been absconding since June this year."
The diplomat was taken into custody by law enforcement authorities in New York Thursday while she was dropping her daughter at school, it said. She was later released in the evening.
The embassy statement said: "The Delhi High Court had issued an-interim injunction in September to restrain Richards from instituting any actions or proceedings against Khobragade outside India on the terms or conditions of her employment."
"The US Government had subsequently been requested to locate Richard and facilitate the service of an arrest warrant, issued by the Metropolitan Magistrate of the South District Court in New Delhi under Sections 387, 420 and 120B of the Indian Penal Code," it said.
Bharara, on the other hand, alleged Khobragade had prepared and electronically submitted an application for an A-3 visa for an Indian
national, who was to be her personal employee at a monthly salary of $4,500 per month.
The First Employment Contract stated, among other things, that Khobragade would pay the unnamed "Witness-1 the prevailing or minimum wage, whichever is greater, resulting in an hourly salary of $9.75."
However, prior to the signing of the First Employment Contract, Khobragade and Witness-1 had agreed that she would pay 30,000 rupees per month, which at the time was equivalent to $573.07.
She also instructed Witness-1 to say that she would work 40 hours per week, and that her duty hours would be 7 a.m. to 12:30 p.m., and 6.30 p.m. to 8.30 p.m.
She told Witness-1 that the First Employment Contract was a formality to get the visa, the statement alleged.
In fact, witness-1 worked for Khobragade as a household employee in New York from November 2012 through June 2013 for more than 40 hours per week and was paid less than 30,000 rupees per month, or $3.31 per hour, it alleged.

Both the cases are brought up by individuals came from India to get legal status in USA. The following should be done by Govt of India immediately:
Protect the Consulate officials under the laws applicable to international diplomatic missions, and request the US court to send back both the accused and the accuser back to India immediately rather than subjecting them to US Laws.
The person came to USA as a domestic worker of the Dy. Consul General Dr. Devayani, used that opportunity to get Green Card and then US Citizenship exploiting the loop holes of US immigration laws. Same thing happened last time when CG Prabhu Dayal brought a domestic worker from India! I do not know how many millions were spent in the earlier case by Govt of India to rescue the CG Prabhu Dayal. Now, another litigation!!
There is something basically and seriously wrong happening in the External Ministry of India that is an expert in 'Outsourcing' embassy/consulate services and sending incompetent and ill advised [ legally and administratively] personnel to work in foreign missions.
WHO SUFFERS ULTIMATELY, THE PRAVASIS AND MOTHER INDIA!!

WHATEVER BE THE ALLEGATIONS/CHARGES THE US AUTHORITIES SHOULD HAVE TAKEN STEPS TO CONSULT GOVT OF INDIA BEFORE ARRESTING A DIPLOMAT OF INDIA. HAPPY TO LEARN THAT DELHI SUMMONED THE US AMBASSADOR TO INFORM INDIA'S PROTEST TO USA.
